Residential and Commercial Transactions We represent buyers, sellers and lending institutions in all aspects of residential and commercial real estate transactions. Our services include negotiating purchase and sale agreements, assisting in due diligence investigations to determine regulatory compliance, reviewing
and analyzing title examinations, preparing closing documents, conducting the closing, recording documents, and attending to post closing administrative matters.
Land Use Permitting Drawing upon our legal training as well Mr. Knapikís experience as a civil engineer and a land surveyor, we assist developers in the acquisition, permitting, financing, and construction of residential and commercial land development projects. We regularly appear before municipal planning boards, zoning boards, and conservation commissions on behalf of proponents of land development projects. As part of a land development project team, we work closely with clients and their engineers, architects, and other consultants to ensure a coordinated and strategic approach to project permitting and development. Mr. Knapik has extensive experience in obtaining affordable housing permits pursuant to G.L. c. 40B. He has also represented developers in appeals related to land use and environmental matters before appellate courts, trial courts and administrative bodies including the Department of Environmental Protection and the Housing Appeals Committee within the Department of Housing and Community Development.
Condominium Development and Conversion We assist clients in the process of developing multifamily housing or converting existing multifamily properties to condominium form of ownership. We work closely with property owners and other professionals to navigate the often complex issues relating to condominium development, acquisition, financing and sale of individual units.
Commercial Leasing Commercial lease review and drafting can comprehend many areas of real estate law and environmental law. With a broad and interdisciplinary background, Mr. Knapik can assist landlords and tenants in negotiating, interpreting, and properly documenting commercial leases and related documents including options to purchase, extended lease term options, and non-disturbance agreements.
Corporate Formation We assist clients in need of the protection provided by corporate entities, including for-profit corporations, limited liability companies, and not-for-profit corporations. Services include selecting the appropriate form of entity, preparing and filing the necessary formation documents, and providing counsel in the transfer of ownership interests, corporate financing, and related corporate legal matters.
Contract and Real Estate Disputes We represent litigants in civil disputes in trial courts and appellate courts. Representative matters include successfully defending a breach of contract and misrepresentation claim relating to a real estate development project, and obtaining a decision from the Massachusetts Appeals Court upholding a lower courtís favorable decision.
Landlord Tenant Law We regularly represent commercial and residential property owners in eviction matters from filing complaints in appropriate courts through trial and settlement negotiations.
Estate Planning We work closely with clients to prepare an individualized and comprehensive estate plan that protects client assets and ensures that the clientís estate will pass through appropriate mechanisms and in accordance with the clientís wishes. Estate plans can include such documents as a last will and testament, trusts, health care proxy, and durable power of attorney.
Probate and Estate Administration We represent clients in the court-supervised probate process and settlement of decedents' estates and the distribution and disposition of estate assets.
